Seven states — California, Colorado, Maine, Maryland, Minnesota, Oregon, and Washington — have enacted comprehensive packaging EPR laws, each with different producer definitions, exemption thresholds, registration deadlines, reporting formats, and fee structures.

What is packaging EPR?

Extended Producer Responsibility (EPR) shifts end-of-life management costs for packaging from municipalities to the companies that introduce packaging into the market. Producers pay fees based on the type, volume, and recyclability of their packaging.

Am I a covered producer?

Producer definitions vary by state but generally include brand owners, manufacturers, and importers who sell or distribute packaged products into the state. Revenue and volume exemptions exist but differ. An applicability screening determines your status in each state.

What is a PRO?

A Producer Responsibility Organization (PRO) manages collective compliance on behalf of its member producers. The Circular Action Alliance (CAA) is currently the primary approved PRO across most enacted states.

Do I need to register in every state?

If you sell packaged goods into a state with an enacted EPR law and exceed that state’s exemption threshold, you likely need to register — either through a PRO or individually. A multi-state screening identifies where you have obligations.

What data do I need to prepare?

At minimum: product catalogue, packaging materials and weights, states of sale, annual revenue by state, and brand/trademark ownership. More detailed data (recycled content, recyclability classification) may be needed for fee modulation.
